Do you know if your fire protection service provider is licensed or qualified to do the work that they are doing? Don't just assume that they are - you may be breaching your WHS obligations as well as putting your insurance cover at risk. In Queensland, holding a licence is a mandatory requirement for fire protection service providers - it is illegal to perform fire protection work without this licence. This licensing is managed via the Building Services Authority (BSA). Elsewhere, licensing is not currently a requirement, however this doesn't necessarily mean that it's ok to use a non-qualified provider. To accomodate this obvious gap, the Fire Protection Association Australia (FPAA) is operating their Fire Protection Accreditation Scheme (FPAS) which is slowly being rolled out to all facets of the fire protection industry. FPAS is being closely watched by Regulators around Australia who are showing interest in its implementation Australia-wide. This was the major topic of discussion at FPAA's recent Fire Australian conference in Sydney. In any workplace safety incident that results in serious harm, injury or death, a full investigation into the cause of the incident takes place. For a fire safety incident, this investigation would include a review of the site's installed fire protection system and the level of maintenance that has been conducted to ensure it is fully operational. Maintenance records are reviewed and questions are asked regarding the service provider and whether or not they are appropriately qualified to conduct the work that they have been doing. Some may say, "Well, it's the contractor's responsibility to be appropriately qualified". This is indeed true, however make no mistake - it does not take away your responsibility as the person conducting a business or undertaking to ensure that you provide a safe workplace. It is your responsibility to ensure you only contract qualified (and, in the case of Queensland, licensed) providers. You need to have a procedure in place to ensure that relevant checks are done and recorded. Do not use contractors that you are not satifisfied are qualified or, in Qld, licensed.
