Peter Duffield

Peter is the principal of Duffield and Associates Solicitors. Peter has extensive family law and litigation experience. Peter has five University qualifications including a Masters degree in law and accounting qualifications and has the advantage of being able to use his University qualifications in both law and accounting to benefit his clients.

Peter has practiced significantly in the involved area of family law since 2003. Since 2003 Peter has practised predominantly as a family lawyer representing hundreds of people across Central Queensland as well as interstate and overseas in property, parenting, domestic violence and child support matters. Clients continuously benefit from Peter’s significant knowledge of family law. Peter was drawn to practice in family law as it allows him to apply his vast experience in a manner that assists everyday people through what can be one of the most challenging and stressful times in their lives. Peter assists clients to remain focussed on the “overall picture” and achieving the best overall outcome, rather than allowing matters to become entrenched in the emotional turmoil that family law matters often involve.

Prior to becoming a lawyer, Peter worked as an accountant in a national accounting firm. Initially commencing his career as a lawyer in two national law firms in Brisbane and later in Sydney, Peter gained exposure to a variety of very high level commercial work. Thereafter, Peter has practiced predominantly in family law since 2003.

With his previous commercial experience as a lawyer and accountant Peter has developed a particular interest and particular technical skills in de facto and matrimonial property matters, including large, complex matters and large rural property matters. He provides his clients with strategic advice and solutions by analysing complex financial arrangements in consultation with clients’ other professional advisers such as accountants and financial advisors.

Peter is a member of the Family Law Practitioners Association, holds directorships of a range of private companies and is admitted as a lawyer in England and Wales and throughout various Australian State Supreme Courts.

Peter is a passionate family law advocate who, through his accumulated skills and experience, attempts to ensure that every possible advantage available to a client is maximised.

Gemma Smith

Gemma has predominantly been practising family law since her admission as a lawyer in 2009. She has dual University degrees in law and science (majoring in biological science and psychology) and has the advantage of being able to use her qualifications in both psychological science and law to benefit her clients. Gemma has a reputation for settling family law matters and for skillful and empathetic representation in a very emotional environment. She has experience in all aspects of this diverse area including parenting, property, child support and family violence and is a member of the Family Law Practitioners Association.

Gemma is particularly fond of parenting matters. Gemma’s fondness for parenting matters has involved her in matters involving children across all stages of childhood and particular needs. Gemma has acted for both mothers and fathers in parenting matters which are very involved, including matters with parental alienation, parentage (DNA) testing, family violence, sexual abuse allegations and relocation and recovery of children.

The importance of settling matters causes Gemma to try to find practical solutions that work for each individual client. Gemma prefers to try to settle both parenting and property matters by consent with the other party before proceeding to litigation. Gemma has a history of obtaining positive results for her clients by agreement without litigation. She has a particular strength at settling matters at mediation. Gemma is experienced in all aspects of alternative dispute resolution, including mediation and negotiations and conferencing and has a particular interest in the benefits of alternative dispute mechanisms especially in relation to matters involving children. According to Gemma, this enhances the outcome for both
parties and their children.

Gemma understands people and is well versed in assisting people through a tough time in their lives. She is very personable and represents a strong voice for her clients.

Matthew Lynch

Matt holds a Bachelor of Laws, and a Bachelor of Arts majoring in Philosophy and Politics and Economics. Matt has worked predominantly in the area of family law and civil litigation since joining Duffield and Associates in August 2012, and has since assisted many clients in resolving their legal matters.

Matt has a particular interest in property settlements, binding financial agreements and spousal maintenance.

Matt assists his clients to achieve a smooth resolution of their matter in a way best suited to each particular client’s needs. He recognises that whilst litigation is an option for clients, it need not be their first. He has been involved in many family law matters broadly encompassing parenting matters, de facto property matters, and matrimonial property matters. These matters have included serious issues affecting children, domestic violence, and complex property disputes.

Outside of his work, Matt has volunteered his time to the Central Queeensland Law Association’s coordination of the annual debating competition last year, and maintains a keen interest in rugby, surfing, and skiing.
